4. HIPAA & Business Associate Agreements (BAA)

When we act as a Business Associate under the Health Insurance Portability and Accountability Act (HIPAA) and its implementing regulations, we enter into a Business Associate Agreement (BAA) with the applicable Covered Entity. This BAA governs our obligations regarding the use, disclosure, privacy, and security of PHI.

Key commitments under our BAAs include:

  • Using and disclosing PHI only as permitted by the BAA, the underlying service agreement, or as required by law
  • Implementing appropriate administrative, physical, and technical safeguards to protect PHI
  • Reporting any breaches of unsecured PHI without unreasonable delay
  • Ensuring subcontractors who handle PHI also sign BAAs
  • Making PHI available for individual access, amendment, and accounting of disclosures as required
